AFX provides an AI-driven messaging automation platform that integrates with third-party messaging services (WhatsApp, Facebook Messenger, Instagram Direct, and Email). Our service enables automated communication, appointment scheduling, and customer support powered by generative AI technology.

3. Account Responsibility

To use certain features, you may be required to register or connect your business accounts. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use Policy

You agree not to use the service for any unlawful purposes or to transmit any content that is: (a) offensive, abusive, or discriminatory; (b) non-compliant with third-party platform policies (e.g., Meta's Commerce Policy); (c) intended for spamming or unauthorized marketing; or (d) containing malware or viruses. We reserve the right to terminate access for users who violate these policies.

5. AI Nature & Limitations

You acknowledge that our service utilizes generative Artificial Intelligence. While we strive for accuracy, AI-generated responses may occasionally contain errors, hallucinations, or inconsistencies. AFX should not be used as the sole source for legal, medical, financial, or other critical advice. Users are responsible for verifying any critical information provided by the AI.

6. Intellectual Property

Our service, including its original content, features, and functionality (excluding user-provided content and third-party APIs), are and will remain the exclusive property of AFX and its licensors. You retain ownership of the data you provide, but grant us the necessary rights to process such data to deliver the service.

7. Termination

We may terminate or suspend your access to our service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

8. Limitation of Liability

In no event shall AFX, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, or other intangible losses, resulting from: (a) your access to or use of the service; (b) any conduct or content of any third party on the service; or (c) any AI-generated communication.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which AFX operates, without regard to its conflict of law provisions.
